AMENDMENTS TO THE LAW ON BAILIFFS

GOAL

Prevent the adoption of amendments to the Law On Bailiffs proposed by the Ministry of Justice.

IDEA

The Ministry of Justice, upon the initiative of the Sworn Bailiff Council, developed  “Amendments to the Law On Bailiffs”, which provided one group of state officials exclusive powers to conduct profit-generating business activities in contradiction with Law On Prevention of Conflict of Interest in the Conduct of Public Officials. Even though all other organisations involved (Corruption Prevention and Combating Bureau, Consumer Rights Protection Centre. etc.) were expressly against such amendments to the law, pointing out that passing such regulation will increase corruption, cause uncontrollable and illegal activity among bailiffs, increase the administrative burden, overload the courts even more and undermine the protection of rights and interests of consumers, the Ministry of Justice submitted the bill for review by the Legal Affairs Committee of the Parliament (Saeima), which served as an alarm signal for the matter to be transferred for discussion in the public space.

The project included activity on attracting allies, opinion leaders, industry supervisory organisations and agencies. The intensive outreach in the public space and use of mass media caused a public uproar, to make sure that the legislature does not pass a decision that is against the public interest and can threaten the existence of the entire industry.
